When To Call A Workers Comp Lawyer

The short answer is:  As Soon As Possible!

Why is this the case? 

The reason is simple:  Because following a work injury, the workers comp insurance companies, and, very often, your Employer will go to work immediately to defend against a potential claim.  You need someone to go to work for you right away, to ensure that your rights are protected. 

They can do this in a variety of ways.  Very often, they will attempt to steer you away from the workers compensation system.  They may tell you that "you'll be taken care of."  Or, they may try to steer you towards a private disability policy.  This may seem like the quickest and best way for you to be taken care of, and, sometimes it is.  But the problems arise when the work injury results in a lengthy treatment process, or a prolonged period of disability.  

Short terms disability benefits, for example, only run for 3 months (usually).  Long term disability benefits can run longer (sometime 2-3) years.  But the reality is that work injuries don't have a set time frame.  It is not uncommon for a work injury to last many, many years.  It is equally not uncommon for the work injury to last throughout a lifetime.  This is compounded if your private health insurance later finds out that the injury happened at work.  Any treatment they paid for, the will pull back, and send you the bills.  In these situations, it is vital for workers comp to be on the hook from the very beginning.  The longer it takes workers comp to come into the picture, the harder it becomes to get them on the hook.  It's that simple.
