Do I Still Need An Attorney If I Am Getting Workers’ Comp Benefits?

The short answer is Yes.

Why would you need an attorney if you are already getting paid weekly checks and they are approving your medical care?

The reason is that the workers comp insurance company has their own agenda. And an injured employee who is unrepresented is the perfect target for them to protect their own interests at the expense of the injured worker.

Following an injury at work, the workers compensation insurer may very well do the right thing. That is, start paying you weekly disability checks while you’re out of work, and approve your necessary medical care. In this situation, all may seem well. However, it is during this critical early stage of the process where they can do the most damage to the injured workers case in the long run.

One example may be trying to lure the injured worker back to work too early. Or to a different position. This happens frequently. Then, once the injured worker returns, many employers will recognize the potential liability of having the injured employee in their organization and take steps to terminate or lay off that individual. In this situation, it is much harder to claim disability benefits given that the injured worker returned to work.

Far too often, injured workers seek out counsel too late. And this makes the job of the attorney much more difficult. Had an experienced workers comp attorney been involved from the beginning, he or she would have likely have been able to steer the injured workers clear of these potential pitfalls.

If the workers comp insurer does what they are supposed to do at the early stages, it is still vitally important to have an experienced workers comp attorney by your side. Very often, this simply means staying in the background, providing practical advice, and keeping an eye on things as they progress. Often times, an attorney who jumps into the mix too quickly and files their appearance on a case when all is going well can cause more problems than they solve.
